The CoC is a juristic person under the IBC. The CoC can litigate under its own name under the IBC.
In CoC of Think and Learn Pvt Ltd v Rjju Ravindran, Company Appeal (AT) (CH) (Ins) No. 475/2025, NCLAT Chennai that the CoC cannot claim a juristic character due to ‘jurisprudential inadequacies’. But held that practice of the CoC litigating under its name should not be discontinued.
