Can a creditor file CIRP application against a statutory body such as Securities and Exchange Board of India (‘SEBI’) or National Highway Authority of India (‘NHAI’)?
In HCCL v Union of India AIR 2020 SC 122, the Supreme Court clarified that NHAI is a statutory body that which performs governmental functions. And it cannot be taken over by a resolution professional or any other corporate body under the IBC.
