A corporate debtor who intends to voluntarily admit to CIRP is permitted to file a CIRP application against itself in the NCLT. However, a corporate debtor is not allowed to voluntarily initiate liquidation proceedings against itself.
Under Section 10 of the IBC a corporate debtor can file a CIRP application against itself. While under Section 59 of the IBC a corporate which wishes to liquidate itself voluntarily can initiate voluntary liquidation proceedings.
