During liquidation of corporate debtor, a liquidator can choose to sell it as a going concern if in its opinion such a sale is likely to maximize the value of assets of such corporate debtor.
Currently, the liquidator is not permitted to sell corporate debtor as a going concern. This option was available under Regulation 32A, Liquidation Regulations, 2016 but was omitted in 2025.
