In Kalyani Transco v M/S Bhushan Power and Steel Limited and Others 2025 INSC 1165, the Supreme Court held that the CoC continues to exist until the resolution plan is implemented, or an order of liquidation is passed under Section 33 of the IBC. Further the Supreme Court added that the CoC will also continue to exist until an appeal is decided by it under Section 62 of the IBC.
