A public trust which operates under the General Public Utility (‘GPU’) category cannot do business.
Need a hint?
A bit of both is advisable.
A public trust which operates under the GPU category can engage in trade, commerce or business if the aggregate receipts from its business do not exceed 20% of its total receipts in a financial year. See, for example, Assistant Commissioner of Income Tax (Exemptions) v. Ahmedabad Urban Development Authority [Civil Appeal No. 21762 of 2017].
